There can be significant financial, commercial and reputational consequences for businesses that infringe competition law. But there are also many ways in which they can legitimately include restrictions in their commercial contracts.
The seminar will take you through the key competition law issues to be aware of when drafting commercial contracts. We will cover the competition law implications of adopting different distribution models, non-compete and exclusivity obligations and restrictions on online selling, territories and pricing.
As we work through these issues, we will consider:
• the practical risks that can arise
• potential approaches to mitigation
• current 'hot topics' for competition authorities
• UK and EU implications, including the possible effects of Brexit
